We believe that learning and personal development are best achieved in a fun and safe atmosphere, and your confidence in our privacy practices is essential to our success.

This Privacy Policy ("Policy") describes how we collect, use, and disclose information through the websites, software, applications, online services, and products that link to or post this Policy and are operated by alphaTUB Innovations Private Limited or its related corporate entities ("alphaTUB") (collectively, the "Services").

This privacy policy is integral to the Terms of Service guidelines as provided on this website.

1. INFORMATION WE COLLECT
The circumstances in which parents may provide information include, without limitation, when they register for the Services, to access various content or features including sharing on social media or similar platforms, sign up to receive emails or other communications, use community features such as our parent community blogs and discussion forums, participate in promotions, use a send-to-a-friend feature, or directly contact us with questions or feedback.

The information that parents or teachers may provide includes:

  •  User generated content, especially in the form of TUB Sheets, Analytic & Reports which is shared by the App users;
  •  Contact information, such as first and last name, e-mail address, postal address, and telephone number;
  •  The child's first name and demographic information, such as age, grade level, birth date and gender;
  •  The name of the school which might include pre-school or kindergarten, the location of the school, e-mail address, postal address, and telephone number;
  •  Contact information of the teachers, such as first and last name, e-mail address, postal address, and telephone number;
  •  User name, password, and answers for password reminders;
  •  Search queries;
  •  Country and / or state of residence;
  •  Communications preferences;
  •  Comments and other information posted in our interactive online forums;
  •  Correspondence and other information that you provide;
  •  Survey-type information, such as information about the parent's or child's hobbies, attitudes, interests, skills, and education level; and
  •  Billing information, including credit card information, when you purchase Services. Children may provide first name and grade in child profiles on some child-facing  Services.
     We also may collect certain information automatically when parents or children use the Services, including:
  •  Usage data that shows how parents and children use and interact with the Services, including information about how your child performs and progresses on activities when  using the Services (such as play duration, correct answers, etc.);
  •  Child's wish list selections, if a parent has authorized the child's access to the alphaTUB App Center from certain Services;
  •  Your browser type and operating system, sites you visited before and after visiting the Services, information about the links you click and pages you view within the Services,  and other server log information;
  •  Order history of the products that you buy or download online;
  •  Persistent identifiers, such as alphaTUB device identification numbers and your Internet Protocol (IP) address, which is the number automatically assigned to your computer  whenever you access the Internet and that can sometimes be used to derive your general geographic area;
  •  Information collected through cookies, web beacons, and similar technologies; and
  •  Information about your interactions with e-mail messages, such as the links clicked on and whether the messages were opened or forwarded.

alphaTUB may use cookies, tags, web beacons, and similar Internet technologies in connection with the Services.

We also may obtain additional data, or enhance, update, or add to our existing records with information we acquire from third-party sources, such as data aggregators and third party promotional partners.

When parents or users access third-party services, such as Facebook, YouTube, Instagram or Twitter, through the Services to share information about the Services with others, we may collect information from these third-party services.

2. CONTENT UPLOADED BY YOU
You hereby represent and warrant that in respect of any content including without limitation any textual content, comment, image or video (together "Content") uploaded to the Website and / or transmitted to any member via the Website by you that:
  •  you have the right to publish such Content (whether by virtue of ownership of the intellectual property rights in such Content or as a result of the grant to you of a license to    use and publish such Content);
  •  the publication of such Content on the Website is not likely to bring our reputation into disrepute;
  •  such Content:
    • is not illegal in the India or in any jurisdiction in which such Content
    • does not promote terrorism or assist any person in committing or
    • such Content does not encourage or promote any political cause or
    • such Content is not of a pornographic, sexually explicit, violent,
    • such Content does not promote racism, bigotry, hatred or physical
    • such Content does not contain libellous or otherwise untrue
    • such Content does not depict any person less than 18 years of age
    • such Content is not likely to cause offence to any viewer of such
    • such Content is true and not misleading in all material respects might reasonably be expected to be viewed and does not promote any illegal activity; procuring the commitment of any act of terrorism; affiliation or any religious views; offensive or obscene nature; harm of any kind against any person or group of persons; statements about any person (whether living or dead) and does not harass or advocate the harassment of any person; (whether or not decent or indecent); Content; (including without limitation any information and images posted by you relating to your personal statistics, age, occupation and relationship status);
    • does not promote or relate to any pyramid scheme, contest, lottery, sweepstake, or barter activity; and
    • is not likely to lead a viewer to assume that you are related to, authorized by or otherwise represent us.
  • You acknowledge and agree that we may review and approve some or all Content (at our sole and absolute discretion) uploaded to the Website and / or transmitted by you to any other user via the Website.  We shall be entitled to remove any Content without notice and without giving any reason.
  • Further you acknowledge and agree that we may be required to provide information about the origin of any unlawful Content published and / or the occurrence of any unlawful activity occurring on the Website to any police or judicial authority in any country in which such Content has been viewed and is illegal and you hereby irrevocably authorize us to provide such information to such persons (on request or in our discretion) without consulting or informing you.
  • If you view any Content on the Website that you believe breaches any of the above restrictions, you undertake and agree to report such content to us as soon as is reasonably possible.
  • You acknowledge and agree that we shall at all times be permitted to distribute, display, or use for promotional purposes and in advertising or any third party website (including without limitation any social network) any Content uploaded by you to the Website.  Further we may without your consent and / or notifying you post user Content on our profiles on social media websites.
  • On submitting or uploading any Content to the Resource section of the Website, you grant us a non-exclusive licence to use, reproduce, distribute, prepare derivative works of, display and transmit such Content as we reasonably see fit.
  • You hereby acknowledge that we have no control over how other users of the Website use your Content.  By submitting Content, you acknowledge and agree that We shall not be liable for any discrimination or unlawful activity by any user in relation to their use of your Content.
  • You hereby acknowledge and agree that you cannot delete any Content You upload to the Website without our consent.  We may retain any deleted Content in our archives as required by our back-up systems for up to 6 (six) months or more purely at our discretion.
3. USE OF INFORMATION
  • We may use information that we collect through the Services for a variety of purposes, including to:
    • to carry out our obligations arising from any contracts entered into between you and us and to provide you with the information, products and services that you request from us;
    • to provide you with access to the Website;
    • to provide personalized analytics reports that show parents the learning progress for each child or student player for their account;
    • to respond to correspondence that we receive from you;
    • to contact you via email and otherwise about products, services, and events that we think might be of interest to you, including those appropriate to your child's learning progress;
    • ccustomize and personalize your use of the Services to better meet your needs and the needs of your children;
    • to provide you, or permit selected third parties to provide you, with information about goods or services we feel may interest you.  If you do not want us to use your data in this way, or to pass your details on to third parties for marketing purposes, please tick the relevant box situated on the form on which we collect your data;
    • to enable you to interact with agents to your mutual advantage;
    • to notify you about changes to our Website; and
    • to ensure that content on the Website is presented in the most user friendly manner
  • Information we collect about you.  We will use this information:
    • to administer the Website and for internal operations, including effective manner for you and for your computer;
    • to improve the Website to ensure that content is presented in the most user friendly manner;
    • to allow you to participate in interactive features of the Website, when
    • as part of our efforts to keep the Website safe and secure;
    • to measure or understand the effectiveness of advertising we serve to;
    • to make suggestions and recommendations to you and other users of;
  • Information we receive from other sources.  We may combine this information with information you give to us and information we collect about you.  We may use this information and the combined information for the purposes set out above (depending on the types of information we receive), troubleshooting, data analysis, testing, research, statistical and survey purposes; effective manner for you and for your computer; you choose to do so; you and others, and to deliver relevant advertising to you; and the Website about goods or services that may interest you or them.
  • When you provide bank account or credit card information you provide this directly to our payment processor whose privacy policy will regulate the storage of such information.  We will not receive or store any such information.
4. SHARING OF INFORMATION
We are committed to maintaining your trust, and we want you to understand when and with whom we may share the information we collect.
  • Corporate Parents, Affiliates, and Subsidiaries.  We may share your information with our corporate parents, subsidiaries, and other affiliated entities for a variety of purposes, including business, operational, and marketing purposes.
  • Service Providers.  We may share your information with the following third parties:
    • Service providers that perform certain functions or services on our behalf (such as to host the Services, manage databases, process payment information, perform analyses, or send communications for us);
    • Distributors who sell our Services in the country in which you reside; and
    • Vendors alphaTUB employs in connection with marketing and advertising campaigns.
  • Select Business Partners.  We may share your information with select business partners so that they can provide you with special offers, promotional materials, and other materials that may be of interest to you.  We will obtain your permission prior to such sharing if required by law. We take measures to help ensure that our partners protect the confidentiality, integrity, and security of any information we share with them.  However, alphaTUB is not responsible for the privacy practices of these business partners, which may use your information for their own purposes.
  • Other Parties When Required by Law or as Necessary to Protect the Services.  We may disclose your information to third parties in order to protect the legal rights, safety, and security of alphaTUB, our corporate parents, affiliates, subsidiaries, business partners, and the users of our Services; enforce our Terms of Use; respond to and resolve claims or complaints; prevent fraud or for risk management purposes; and comply with or respond to law enforcement or legal process or a request for cooperation by a government or other entity, whether or not legally required.
  • In Connection with a Transfer of Assets.  If we sell all or part of our business, or make a sale or transfer of assets, or are otherwise involved in a merger or business transfer, or in the unlikely event of bankruptcy, a business reorganization, or similar event, we may transfer your information as part of such transaction.
  • Other Parties with Your Express or Implied Consent.  We may share information with third parties when you consent to such sharing, including when you post information to a user profile or a public area of the Services, such as a chat room, forum, blog, or other community tool.  When parents choose to access third-party services, such as Facebook, YouTube, Instagram or Twitter, through the Services, these third-party services may be able to collect information and notify connections on the third-party services about the parent's use of the Services, in accordance with their own privacy policies.  Parents also consent to the disclosure of information when they use password-protected parts of the Services to transfer content to cloud storage, social media, or other recipients.
  • Aggregate Information.  We may disclose to third parties information that does not identify individual users, such as aggregate website usage data or demographic reports.
5. DATA SECURITY
We maintain reasonable security procedures to help protect against loss, misuse, unauthorized access, disclosure, alteration or destruction of the information you provide to us. While we strive to protect your information and privacy, please note that no data transmission or storage can be guaranteed to be 100% secure.  For your protection, before selling or otherwise transferring ownership of an alphaTUB-connected device, please be sure to securely remove all information connected with the device itself, including any play data. 6. CHILDREN'S PRIVACY
As an ethical business practices creator of children's educational toy products, alphaTUB recognizes the importance of protecting children's information, to the extent that alphaTUB App has been carefully crafted for preferred use by parents, elders, teachers and guardians, alphaTUB strongly encourages parents to be actively involved in their children's online activities,
We take steps to avoid collecting personal information from children.  For example, while children may use some of our products to take photographs, create artwork, and record voice memos or video, this content is stored locally on the device and is not transferred to alphaTUB's server unless confirmed by the main user of the App.
In addition, children may access child-friendly activities or play areas using only a username (such as a nickname or character name) or similar non-personal login information.
Chat functionality and similar interactive features if any will be designed to help prevent children from revealing their full names, email addresses, or similar information that could identify the child.
For example, interactive chats may require children to choose from a pre-selected menu of short phrases or emoticons that do not contain personally identifiable information.
We do not knowingly collect, use, or disclose personal information from children without prior parental consent, except as permitted by law.
Parents can access and control their children's information and activities.  For online play areas that contain interactive features, parents may be given additional controls to manage their children's online activities, including the ability to set play time limits and turn certain features on and off.
Prior to taking such actions, the parent may be required to log in to his or her alphaTUB account or otherwise verify his or her identity.
Please note that you may need to separately access and update each child profile under your account in order for certain controls to take effect on every child's profile.
In addition, some of these controls might impact the transfer of data from the software application on your computer to alphaTUB, and may or may not result in the transfer of data from the device to your computer.

7. PRIVACY POLICY UPDATES
We reserve the right to modify this Privacy Policy at any time by posting revisions here.  Your continued use of the Services after any modification to the Privacy Policy constitutes your acceptance of the new terms and conditions.
 
8. LINKS TO THIRD PARTY SITES AND SERVICES
The Services may contain links to other websites or online services that are operated and maintained by third parties and that are not under the control of or maintained by alphaTUB.  Such links do not constitute an endorsement by alphaTUB of those other websites, the content displayed therein, or the persons or entities associated therewith.
This Privacy Policy does not apply to such third-party content or services.  We encourage you to review the privacy policies of these third parties before using their websites or services.
 
9. INTERNATIONAL DATA TRANSFERS
By using the Services, you consent to the collection, storage, processing, and transfer of your information in and to the United States, India, or other countries and territories.
While some of these countries may not offer the same level of privacy protection as your own, alphaTUB commits to uphold the privacy protections as explained in this Policy.

The Website may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates.  If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies.  Please check these policies before you submit any personal data to these websites.

We only retain your information for as long as it is necessary for the purposes for which it was collected.
 
12. DATA RETENTION
We are always working to improve the Services for our users, so these Terms may need to change along with the Services.  We reserve the right to change the Terms at any time, but if we do, we will bring it to your attention by placing a notice on this website or by sending you an email.  If you do not agree with the new Terms, you are free to reject them; but that means you will no longer be able to use the Services.

13. COOKIE POLICY
